1. About These Terms
Welcome to Sandyyolk™.
These Terms of Service ("Terms") govern your access to and use of the Sandyyolk™ website, online store, products and related services ("Services").
Throughout these Terms, "Sandyyolk™", "we", "us" and "our" refer to the business operating the Sandyyolk™ online store.
Our online store is hosted by Shopify, which provides the ecommerce technology that enables us to offer our products and Services to you.
By accessing our website, creating an account or purchasing a product from us, you agree to these Terms and any policies incorporated into them, including our Privacy Policy, Shipping Policy and Returns & Refunds Policy.
Nothing in these Terms excludes, restricts or modifies any right, guarantee, condition, warranty or remedy that cannot lawfully be excluded, restricted or modified under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law (ACL), or other applicable law.
2. Eligibility and Accounts
You must have legal capacity to enter into a contract to place an order with us.
If you create an account, you are responsible for keeping your login credentials secure and for providing accurate and current information.
You must not misuse another person's account or provide false or misleading information when placing an order.
You are responsible for promptly updating information where necessary so that we can process your order and communicate with you.
3. Products and Product Information
We take reasonable steps to ensure that product descriptions, photographs, specifications, dimensions and other information displayed on our website are accurate.
However, product colours and appearance may vary slightly depending on your screen, device settings, lighting and manufacturing variations.
Minor variations that do not materially affect the nature, quality or intended function of a product may occur.
Nothing in this section limits your rights where a product is materially different from its description, does not meet applicable consumer guarantees or otherwise gives rise to a remedy under Australian Consumer Law.
We may update, modify or discontinue products from time to time.
Product availability is subject to stock availability.
4. Product Safety and Responsible Use
Certain Sandyyolk™ products may involve heat, charcoal, fire, hot surfaces or cooking.
Products must be used only for their intended purpose and in accordance with all instructions, warnings and safety information supplied with the product.
Customers should read all safety information before use and exercise appropriate care when using products involving heat, fire or charcoal.
Products designed for charcoal or combustion must not be used in an enclosed or inadequately ventilated space where doing so creates a risk from fire, heat, smoke or carbon monoxide.
Keep hot products, flames, charcoal and ignition materials away from children, pets, combustible materials and other hazards.
Nothing in this section excludes or restricts Sandyyolk™'s obligations concerning product safety or your rights under Australian Consumer Law.
5. Orders
Submitting an order constitutes an offer to purchase the products in your order.
After an order is submitted, you may receive an automated confirmation acknowledging that we have received it.
We reserve the right to decline or cancel an order where reasonably necessary, including because:

a product is unavailable;

payment cannot be authorised;

information supplied with the order is materially incorrect or incomplete;

we reasonably suspect fraud or unauthorised activity;

an obvious pricing or product-information error has occurred; or
-
we are unable lawfully to supply the product.
If we cancel an order after payment has been received and no product is supplied, we will refund the applicable amount paid.
We will not cancel an accepted order merely to avoid obligations arising under Australian Consumer Law.
6. Order Changes and Cancellations
If you need to change or cancel an order, contact us as soon as possible at:
We will make reasonable efforts to accommodate the request.
However, we cannot guarantee that an order can be changed or cancelled once it has entered processing or has been dispatched.
This section does not limit any cancellation or other rights available under applicable law.
7. Prices and Payment
Unless clearly stated otherwise, prices displayed to Australian consumers are in Australian dollars (AUD) and include GST where GST is applicable.
Shipping charges and any other applicable charges will be disclosed before you complete your purchase.
You agree to provide accurate billing and payment information and confirm that you are authorised to use the payment method submitted with your order.
Prices may change from time to time. A subsequent price change will not ordinarily affect an order already accepted by us.
Promotional offers may be subject to separate conditions disclosed with the promotion.
Where an obvious pricing error occurs, we may contact you to explain the error and, where legally permitted, provide you with the opportunity to proceed at the correct price or cancel the affected order for a refund.
Nothing in this section permits Sandyyolk™ to engage in misleading pricing practices.
8. Shipping and Delivery
Shipping destinations, charges and estimated delivery times are provided on our website or during checkout.
Delivery estimates are estimates rather than guaranteed delivery dates unless we expressly state otherwise.
Orders may be fulfilled and dispatched by Sandyyolk™ or by third-party suppliers or fulfilment partners acting in connection with your order.
The use of a third-party supplier, fulfilment provider or carrier does not remove any responsibility Sandyyolk™ has to you under applicable Australian law.
Delays may occasionally occur because of carrier disruptions, customs processes, weather, emergencies or other circumstances outside our reasonable control.
If there is a significant delivery problem, please contact us at support@sandyyolk.com so that we can investigate.
Nothing in these Terms excludes any rights you may have where goods are not supplied within the required or agreed time.
9. Delivery Information
You are responsible for providing a complete and accurate delivery address.
If an order cannot be delivered because materially incorrect or incomplete information was supplied by you, reasonable redelivery or return costs may apply.
We will not impose such costs where doing so would be inconsistent with your rights under Australian Consumer Law.
Please contact us promptly if you notice an error in your delivery information.
10. Returns, Refunds and Consumer Guarantees
Our voluntary change-of-mind return arrangements are described in our Returns & Refunds Policy.
These voluntary arrangements are separate from your statutory rights.
Products sold by Sandyyolk™ come with consumer guarantees that cannot be excluded under Australian Consumer Law.
Depending on the circumstances, if a product fails to comply with an applicable consumer guarantee, you may be entitled to a repair, replacement, refund, compensation or another remedy provided by law.
Our voluntary return period does not limit the period during which rights may exist under Australian Consumer Law.
Nothing in our Returns & Refunds Policy or these Terms excludes, restricts or modifies those rights.
11. Faulty, Damaged or Unsafe Products
Please contact support@sandyyolk.com if you believe a product is faulty, damaged, unsafe, materially different from its description or otherwise fails to meet an applicable consumer guarantee.
We may reasonably request information such as your order number, photographs, videos or a description of the issue to help us assess the product.
Where Australian Consumer Law requires us to provide a remedy, we will do so in accordance with our legal obligations.
We will not require you to retain original packaging as a condition of exercising a right under Australian Consumer Law.
12. Change-of-Mind Purchases
Sandyyolk™ currently provides an additional voluntary 30-day change-of-mind return policy for eligible products.
The eligibility requirements and process are contained in our Returns & Refunds Policy.
Conditions applying to voluntary change-of-mind returns, including requirements relating to unused products, packaging and return shipping, do not restrict rights arising under Australian Consumer Law.
13. Promotions and Discount Codes
Promotions, discount codes and special offers may have separate eligibility requirements, validity periods and conditions.
Unless otherwise stated, promotional codes:

cannot be redeemed for cash;

cannot ordinarily be combined with other offers; and
-
must be used within any stated validity period.
We may cancel or refuse the use of a promotional code where it has been obtained or used fraudulently or contrary to its disclosed conditions.
Sale and promotional products continue to have all applicable rights under Australian Consumer Law.
14. Intellectual Property
Unless otherwise indicated, content created for the Sandyyolk™ website, including Sandyyolk™ branding, logos, text, graphics, photographs, videos, website design and original materials, is owned by or licensed to Sandyyolk™ and is protected by applicable intellectual property laws.
Third-party trademarks and materials remain the property of their respective owners.
You may access our website for personal and lawful use.
You must not reproduce, commercially exploit, distribute or materially modify our protected content without permission, except where permitted by law.
Nothing in these Terms transfers ownership of Sandyyolk™ intellectual property to you.
15. Reviews, Photographs and Other Content
If you voluntarily submit a product review, photograph, video or other content to Sandyyolk™, you confirm that you have the right to submit that content.
You grant Sandyyolk™ a non-exclusive, worldwide, royalty-free licence to reproduce, display and use that content in connection with operating and promoting Sandyyolk™, subject to applicable law.
We may moderate or remove content that is unlawful, fraudulent, defamatory, abusive, infringes intellectual-property rights or otherwise breaches these Terms.
We will not knowingly alter customer reviews in a manner that creates a false or misleading impression of consumer opinion.
16. Acceptable Use
You must not use our website:

to infringe another person's intellectual-property or privacy rights;

to distribute malware or malicious code;

Those third parties may operate under their own terms and privacy policies.
We are not responsible for independent third-party websites that we do not control.
However, nothing in this section excludes responsibility that Sandyyolk™ cannot lawfully exclude, including responsibility arising under Australian Consumer Law.
18. Shopify
Our online store uses ecommerce technology supplied by Shopify.
Purchases from the Sandyyolk™ store are transactions between you and Sandyyolk™, not purchases from Shopify.
Shopify may process certain information in connection with providing its platform services, as further explained in our Privacy Policy and applicable Shopify privacy documentation.
19. Privacy
We handle personal information in accordance with our Privacy Policy and applicable Australian privacy laws.
Our service providers, including Shopify, payment providers, fulfilment providers and other technology providers, may process information required to provide our Services.

20. Website Availability and Information
We take reasonable steps to maintain our website and keep information accurate.
However, websites and electronic services can occasionally experience interruptions, errors or technical problems.
To the extent permitted by law, we do not guarantee uninterrupted or error-free website availability.
We may correct genuine typographical, technical, pricing or product-information errors when identified.
Nothing in this section permits us to avoid an obligation or remedy required by Australian Consumer Law.
21. Liability
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified.
To the extent permitted by law, Sandyyolk™ is not responsible for loss caused solely by:

circumstances for which Sandyyolk™ is not legally responsible.
Any limitation contained in these Terms applies only to the extent permitted by law.
Nothing in these Terms excludes liability where exclusion is prohibited by law.
22. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
Consumer guarantees may include requirements that goods:

are safe and durable;

are fit for their usual purpose;

match their description;

correspond with applicable samples or demonstration models; and

satisfy any additional applicable consumer guarantees.
Your rights under Australian Consumer Law apply independently of any voluntary warranty or return policy offered by Sandyyolk™.
Nothing in these Terms is intended to misrepresent, exclude or restrict those rights.
23. Changes to These Terms
We may update these Terms from time to time where reasonably necessary, including to reflect changes to our Services, business practices or legal obligations.
The current version will be published on our website together with its effective or last-updated date.
Where required by law, we will provide appropriate notice of material changes.
Changes will not retrospectively remove rights that have already arisen under an existing purchase or applicable law.
24. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or severed to the extent necessary and permitted by law.
The remaining provisions will continue to operate.
25. Governing Law
These Terms are governed by the laws applicable in Victoria, Australia, and the laws of the Commonwealth of Australia applicable there.
Nothing in this section restricts any right a consumer may have to bring proceedings or seek assistance in another jurisdiction where applicable law provides that right.

27. Entire Agreement
These Terms, together with our Privacy Policy, Returns & Refunds Policy, Shipping Policy and any other terms expressly applicable to your purchase, form the agreement governing your use of our Services.
If any provision conflicts with a right or remedy that cannot lawfully be excluded under Australian law, the applicable law prevails.
